I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile. Hello,
Got H1B this year via consultant,valid from Oct 1st to 2010. Applied for AOS(dervative) and got EAD, AP and I-485 receipt notice by Oct end. So I think my status is AOS now.
I haven't been put on project yet.
Planning to travel next month using AP.
On return I plan to find another job using EAD.
I wanted to know if and how using AP to re-enter effects H1B status.
Also will this "bench" period effect GC processing in anyway?

Also i would appreciate if gurus could suggest what documents to carry to show at POE, along with AP.

Hi,
I was on H4 and had applied for H1B in 2008. After long processing and being pending for a long time it finally got approved in July 2009.
My question is, does my H1B start from oct 2008 or oct 2009? Can someone reply me on this.

Hi All,
I went for visa interview in December, but my case was stuck because of administrative processing. I came back on Advance parole. I have the following questions.
1. Can I sponsor my parents visitor visa without any issue? Will the consulate quiz them/stop them because of my H-1 admin processing
2. Also is my admin processing still going on? and can I stamp my H-1 visa in the future after my case is cleared from admin processing.

Do u know if its possible to schedule an earlier fingerprinting date? can we just walk to a ASC with our appointment letter and get our fingerprinting done?
I filed for AOS at the beginning of May and had fingerprints done one month later. How quickly do you want them done?

Hi Folks,
I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.

I am in an awkward position and any help will be greatly appreciated. Here is the run down:
- I am currently on an H1B that is scheduled to expire on May 15th, 2007 as per the stamp on my passport.
- I have accepted employment with another organization based on my EAD (485+140).
- The catch is that I plan to re-enter the US on April 21st, 2007(Saturday) but technically my employment will cease with the employer who filed my H1B on April 20th (Friday).
- I have applied for my travel document (I131-based on 485) but it will probably not arrive before I leave the country.
Questions:
- Can I re-enter on my H1B, although technically my employment ceased a day earlier?
- When do H1B�s technically expire after termination of employment?

I am currently working for Company A on h1b, expiring on May 31st 2010. The GC application is denied based on on A2p issue with company A.
I had company B already filed for my labor in 2008 and approved in Jan 2009. They also filed concurrent 140 and 485 in March 2009 which is still pending. Company B wanted to hire me and now its time that I move to company B. I do have latest paystubs from Company A, currently valid i797 and experience letter.
can I migrate to company B by transfering my h1b based on approved labor with company b and pending GC application. What documents are required to transfer.

No, I haven't used Optimaze yet. Their reports say that SWF files are significantly reduced in size. I don't have any first-hand experience to tell you if it is true or not though :(

My kid brother (15 years old and US Citizen) lives in India with my parents. They are quite elderly now to take care of him and we were thinking of bringing him to US legally to live with us. We want to adopt him so that he can have a good lifestyle here and have no issues legally in future. Is there anyone who has gone through similar case before ? Also, I wanted to ask if there are any attorneys that specialize in cases like these ? If so please let me know and I would like to hold a consultation asap.
