Got my MS diploma in Dec 2004 (non thesis). Went on H1 in Oct 2004. Applied for GC in Feb 06 as EB2 and I got it without any issues. I know another friend of mine who joined with me in June 2004. He actually took classes later to finish his MS and finally graduated in December 2005 and he too got his Eb2 approved. The GC is for future job and not the current one so according to me it should be fine.

My H1 Visa is about to expire in month of November 2009
Right now I am on bench and looking for projects
It might happen that I might have to go back to India
My labour is approved and I140 is under process.
Employer is ready to continue my GC processing.
If I go back to India and plan to come after I140 approval would it be possible?
Do I get new H1 on I140 approval or it is important for me to get I140 approval before November 2009
Please guide me

Useless cool facts - AndroidHi, my I94 expires on Nov 28th and my current employer is having issues in applying for transfer (they applied but without proper documents and it is still pending). I know I can continue to work based on the extension receipt they have even after Nov 28th.
I have some questions in the scenario that this application of extension (old employer) is denied after Nov 28th say on Dec 10th:
1) If a new employer applies for H1b transfer before Nov 28th and I get a rejection on Dec10th (with old one), can I immediately switch to the new employer (based on their transfer receipt) and continue work with the new one?
2) If the new employer is unable to apply before Nov28th (with holidays coming up), but say applies on Dec5th. Now if I get a rejection with old employer on Dec10th, can I switch to new employer on Dec10th and continue working (even though they applied for transfer after my I94 expiration but while my stay was legal) ?
Appreciate your responses at this crucial time.

I guess what I was trying to illustrate was that I'll be spending less time in PS trying to bring out detail in the eyes which exactly what I did in my original post edit of the first photo. With the set up I have going now you can see the whites of the eyes better along with the color of the eye to the pupil. So less time in PS = more time shooting. ;)

useless facts of the dayMy wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.

Whm i transferred my H1B to another company, i missed filing filing for H4.
So she was having I 94 of my old company till Nov 2006.
Whn i changed company agn in Dec 06, thats whn i relised her i 94 expired, we submited I 539 for her xtension. but couldnt get it. she exited the country before 180 days of her expiration and planning to apply for new visa in India.
Did anybody had the same experience. Pls share.

My mom is scheduled for an interview for a visitor visa at US Consulate, Chennai. My mom is 70 years old and she will be the only person attending for the interview. She has not travelled a lot and she will not be able to figure out everything that is needed inside the consulate before and after the interview by herself. Now - my question is - Can my mom take anyone (say a relative) with her inside the consulate for help?

No, she cannot carry anyone else except herself inside the consulate. A relative can accompany her till she enters the consulate and your mother can ask for a translator and I am sure there would be people to help her, otherwise too.
But as far as someone accomanying her inside the consulate, NO,
And just in case, even if the relative is able to get in with her, it is not advisable to do so.

Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. Yes you can apply for EAD(I-765)/AP(I-131) anytime during 485 pending and send the notice/fedex tracking as a proof for it if required.
