All,
Today my attorney informed me that TSC approved my I-140. Sighhhhhh.... Approval notice has Notice Date of September 18th. My employer did not receive their copy to date. Ofcourse, I was doing my daily ritual, anxiously checking status several times a day.
USCIS website still showing "Case Received and Pending", ever since I received my receipt to date. Also my 9th year H1 extension for which I received approval notice almost 5 months back, still shows 'Case Received and Pending' to date.
I know many of us praying for a LUD, checking status several times a day. But also check with your attorney/employer as this website status thing appears another USCIS blooper.

We went for FP today and my wife had henna on her hands. I was concerned about it but it never was an issue. The FP went as if she had nothing on her hands instead the FP people pleasently talked abt henna.
We went to the Atlanta office, the staff was pleasent, work flow streamlined and we were done in less than an hour although they looked and checked our hands almost four times for bandages and cuts.

The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. I have an approved i140 from old employer, using which I am planning to file i485 (As PD from old PERM/i140 is current for the month of Aug. & no labor filed for ne employer). As I am in good terms with old employer, they are ready to give me a "future employment letter" for my GC processing.
Can someone please let me know -
1. Format of the letter, details thats needs to be present in it,
2. Anything else I need from the old employer.

can you really claim refund? Is there any rule?
It is specifically mentioned in the forms and online when you file for any applications that USCIS is unable to process any refunds requested by applicants regardless of an error in the application, withdrawal of application or an error on the USCIS's part. The wordings may not be exactly the same but in a nutshell they are saying "NO REFUNDS!!!"
I noticed it when I applied for EAD online and thought I goofed up the application and see what my options are.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

hi, i just got my receipt and fingerprint apointment for the I-485 (mine is a family petition with the I-130 approved) couples of weeks ago(my fingerprint apointment is next week), and yesterday i got a letter with request of evidence that says;
The Household menber (me) on form 864A, Contract between Sponsor and Household Member provided a different address from the petitioner/sponsor on form 864A, Afiidavit of support an/or is not listed as dependent on the petitioner/sponsor's federal income tax return.
Please submit evidense that the household member listed on form I-864A, lives at the same address as the petitioner/sponsor or was listed as dependent on the petitioner/sponsor's federal income tar return
I want to know what can i sent in order to prove that i live in the same house. My stepdad (my peticioner) couldn't put me in his tax because they said he couldn't because i don't have a social security number yet. Do the guy who does our taxes make a letter stating i live there but could'nt be included in the taxes? or should my stepdad do it? or does mail could be consider evidence or a copy of my drivers license with the same address?
My mom went throught the same, they kept asking her for more evidence but eventually she got all her papers. I wish this could be more easy.

My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.
Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.
And there is nothing one can do about it, so i am thinking it will be alright.
We will be fine.

During the interview they will ask for photographs, some questions that reflect that you guys are really in a marriage and the flight tickets and amount of time you spend together and then later get your previous paperwork and this paperwork together and then issue a conditional green card for 2 years and later on third year you can apply for citizenship.

I had this experience in the past...when my H1 Extension is applied sometime back, they gave me a new i-94 number (probably due to an error)....however, when I left the country for a vacation, I stapled & returned both I-94's as per my attorney's suggestion (through my emp)...
