The last few months have been extremely challenging for H-1B applicants as the Department of Labor iCert program for filing Labor Condition Applications has proven to be deeply flawed. Gone are the days of instant LCA approvals. This is really major and thanks to reader gg for posting the link. The headlines are likely to be about the benefits to people out of status. Hello friends,
Would really appreciate if someone can share some information on this topic.
My Labor has been approved as software Engineer in current job, even though all responsibilities are that of Database Administrator.
I am planning to invoke AC21 and my new job responsibilities are an exact match with my current labor, but, the title is Database administrator.
Is there any risk involved in it ?
Any input is greatly appreciated...

Friends,
My friend just forwarded me this link and it shows 1-jun-2006 priority date for EB2. For EB3 it still shows Unavailable. However US State website still shows old dates.

Today I got an SLUD on my pending 485 after almost more than a year. Last one was from July, 2008 (address change). Don't understand what exactly is going on. For RFEs are there usually SLUDs before? or just an hard LUD with message change? Anyone in same boat? :confused:

I am asking this for my sister who is working under J1 (start in October 2007 and valid for 1 year). She already get a J1 visa stamp and re-enter US as J1 status
1. Change of employer is not permissible in J1. Can she submit a new J1 petition and thus ending her current J1 petition early?
2. How about the 2-year home residency requirement (HRR)? Does she need a waiver for the current J1 she is doing now OR can she satisfy the HRR after she finishes with the new J1? The new J1 will not end later than the current J1. So, practically she will be in J1 for 1 year only.
3. Does she need to get another J1 visa stamp and re-enter the US?

I was also in the same boat couple of months back and got two appointments. Technically we can send a letter to USCIS with explanation. But my attorney suggested me to go for the second appointment. So I went twice..

The Labour certification is going to be filed this month end, in that case how long i have to wait to file I140?
Also i heared that I140 and 485 can be filed together.
Is that true? if so what is required from my side to the attorney for those two stages.
