    I am on H1-B, and about to apply for I140.
    My wife has recently got a F1 visa (and her H4 visa has been left valid).
    I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

    Its more like paranoid journalism and the author's background states she has a degree in investigative journalism:mad:

    I don't get it - how can USCIS take a sample of 250 people out of the 65000 visas alotted and say that 21 % of them were fraud ( 13% totally and 8 % technically ) . Its like taking only the fraud cases out of thousands and then saying that there is 100% fraud. I bet the fraud cases are not as high as 20% that the author and USCIS say.

    It is sad to see that although we H1b immigrants get paid more than the American people ( considering what the employer gets from the client ) and even then we have to hear that we are lowly paid. Speaking from my point of view I know I am paid far more than my american counterparts in the same job profile.

    We need to make a very important decision this weekend and any help will be highly appreciated.

    My husband�s (EB3/India) employer is willing to give us a �Labor Substitution/I-140� (PD: March 2005). But, I really want to apply for COS H4 to F1.

    So the two options we have is
    1) Apply for both �Labor Substitution/I-140� and COS H4-F1
    2) Apply for COS H4-F1 and let go of �LC Sub�.

    I have spoken to a lawyer and he is saying that we can apply for both �LC Sub� and COS and that there is a very good chance that COS will also go through, although there is a very small risk. But, I am getting conflicting messages from other sources suggesting there is a high risk of COS being denied.

    We are trying to determine the amount of risk we are taking if we apply for "LC Sub" and COS at the same time. If the risk is high, that we would just apply for COS H4-F1.

    This is a really tough decision and any advice would be greatly appreciated.

    USCIS website does not shows that my I-485 has been denied but instead it says that it has been sent to AAO office(appeal processing office).

    No I have not yet called attorney on extending EAD based on I-140 denial.

    Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

    BTW....did you consult the attorney? If yes, what did they tell you?

    Thanks. It seems I can not extend my J1 (Research Scholar) visa after getting the HRR waiver. Is anyobe aware of any foreign travel restrictions on a valid J1 visa with a granted HRR waiver?

    Guru's help!
    My company wants to transfer me to Europe for 2 yrs. Its a very good opportunity for my career. My I140 approved and 485 is pending. PD March 2006 EB2 India. It wont become current for foreseeable future. I am appplying for 3 yrs of H1B extension.

    Can I be outside the US for 2 yrs w/o jeopardizing the GC process. Can I then come back after 2 yrs on stamped H1?

    My wife used EAD to work. Can I apply her H4 extension with me and she foregoes her EAD? Will she get H4 status and extension along with my H1?

    Can she then come back with me after 2 yrs on H4 and then revert back to EAD to work?

    I need to make a decision soon. Any replies will be greatly appreciated!

    I applied for a green card for my wife just after we were married on May 11, 2009. We received an appointment for an interview in Detroit on August 25, 2009, but we had moved to Texas in the meantime. The appointment was rescheduled at the Dallas field centre on September 14, 2009 (Monday).

    I am wondering what to expect, from the small details to the big stuff. My 3 biggest questions:
    . Does anyone have enough experience to say if there is there reasonable parking available at the field centre? I have never been to Irving. The web page says that there is public parking available, but nothing about how much.
    . I was married before, and applied for a green card for my first wife. It was granted in 2004, and we divorced in 2006. Should I expect extra scrutiny / challenge because of this?
    . Is one actually asked questions of the "What sort of toothpaste does your wife use?" variety? I'm really bad at remembering these details, and am wondering if there's any curve ball that I should expect.
    . Is there a general impression of whether the Dallas field centre is a pleasant or an unpleasant place? My dealings with my first marriage (many years ago) were all with the Chicago field centre, which is very unpleasant, but my one piece of business with the Detroit field centre were easy and pleasant.

    Thanks so much to anyone who can help relieve my nervousness about what to expect.

    UPDATE: I forgot to ask another one: At my previous green card interview, the interviewer asked for a set of passport photos and paystubs for several previous months, although the interview letter had not requested them. I had been warned about this, so I had them with me. Naturally, I am also bringing passport photos and pay stubs this time, just in case. Is there anything else that I might be expected to bring that wouldn't have been mentioned on the interview letter?

    go_getter007: Your Last Updated Date (LUD) will change whenever they touch your file, which means a person has touched your file or an auto touch (soft touch , no case status change in case of soft touch). As of now, Online system is not perfectly synced with actual case status system. Hope this helps.

    Hi,

    My H1 and I-94 and My Wife's H4 and I94 expired on Sep 30th 2008 and applied for extension on July 7th 2008 with Company A. But Company A received an RFE on H1 extension,

    At this movement I have a good offer from company B , can I transfer H1 using Receipt of H1 extension?

    Hello,

    In first place this is not a place where you will have individuals answering questions related to Canadian Immigration. You can look at "http://www.canadavisa.com/canada-immigration-discussion-board" and get more info on the same.

    To answer your questions, In first place this program comes up with few clauses. Your eligibility to apply for this program is contingent upon the fact that you hold a current H1B and are working on H1B for atleast one year. It is also important to prove your H1B status when you get your permanent residency with Canada. With the over flow of applications, they added another clause in the form of eligibility which will make only "IT Managers" eligible for this category. They were taking applications with all NOC codes but offlate around May 29, the eligibility is dependent on your IT Manager role.

    I applied for H1B and Green Card Simultaneously in 2002. My first H1B expired in 2005. I am working on EAD. My questions are--

    If I decide to change jobs and apply for H1B with the new company, am I subject to the QUOTA?

    If I change jobs( in similar field) to another state in another service center, how is my case transfered to TSC from NSC?
