What I wanted to transmit with this pic, apart from the beautiful light, was the inmensity of the sky...I showed so much sky partly to convey that feeling...but I scrolled the image up to see how it looked cropped, and it looks more balanced.....I have to think about this one

Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

There should not be any issues changing the employer after 180 days. This would include proper way of resigning the company so that they don't do anything which will affect your green card.

Hello Attorney,
Is my perm valid if I am out the US without H1 B status? OR
Can I get H1B extension if my perm & I 140 get approved when I am out of the US without H1B status?
Here is my situation:
-My I140/I485 got denied -- in Aug 2009
-I got 9th H1B extension which is valid till Apr 2010
(As I know after Apr 2010 that I am not eligible to get extensions)
-My present company started filing PERM in Dec 2009 (No chances of getting PERM & I 140 approvals before Apr 2010)
-My company planning to send me out of the US (probably India/Japan) in Apr 2010 to work from there because of my H1B expiration. They want to continue my PERM and I 140 process.
My question to the attorneys:
If my PERM get approved after 6 or 8 months I am eligible for H1B extension even though I am out of the country without H1 B status?
Or
Do I need to wait 1 year to get the new H1B for 3+3 years?
I really appreciate your suggestions.

My Lawyer said the same thing. If you say the minimum requirement for a particular job is Bachelors + 5years of exp then every person hired for that position in the past should have Bachelors + 5yrs of exp.

If you don't intend to change your employer, you can travel on AP, comeback and continue working on H1B.

so it looks like the only way out for a prospective indian investor would be to start his enterprise outside usa, get employed in it for 1+ yr, then enter the usa on L1 and apply for GC under EB-5 category?

As as long as your job title says software engineer and your job description is close enough, you should be fine. Junior .. senior doesn't matter and they are pretty common.

- certifications earned from industry recognised bodies like PMP or OCP etc.

market for international students in NY. I will be graduating
in Dec and will be on the job market soon.
Some of my friends say that there are jobs to be had but
not many are keen on sponsoring H1, even non-tarp firms.
Can anyone confirm/refute this?
I heard the same from students in MIT, Harvard as well. I graduated in the 2002 tech downturn, so I know it first hand. Companies pretty much have a ban on hiring H1B.
From the American companies' standpoint H1B has so much headache, most H1B talent is not worth the hassle unless its a critical human resource.

Refer processing times at https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC and search for "All other applicants for advance parole". Right now they are processing July 03, 2007 cases.

Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.
A quick response would be greatly appreciated.
Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs

Does anyone have any experience how long it takes to get the Canadian visa if my family members who are visiting were to travel to the Canadian Consulate in Seattle.
Earlier you used to get on the same day (in matter of hours), but apparently in March of this year, they changed their policy. "Minimum 24 hours" is not a very helpful indicator for planning :(
Temporary Resident Visas (Visitor Visas)
Applications submitted in person are accepted during our walk in hours Monday through Friday 8am to 10am. Effective March 8, 2011, applications submitted in person will no longer be processed on the same day. The minimum processing time will be 24 hours. Passports will not be returned until processing is completed. Processing times for mail in applications vary, please allow at least 4 weeks for processing. The Seattle Consulate does not provide expedited service, if you have urgent travel, it is recommended that you apply in person.

Supposedly, the water in the pool is normally an emerald green color... it was only slightly green when we were there. :(
