On Sept. 14, President Bush signed the Honest Leadership and Open Government Act of 2007, an ethics and lobbying reform bill, which enforces a number of new restrictions.
Under the new law, lobbyists are prohibited from providing gifts, food, beverage and travel to Members of Congress, their staff or employees. A violation of this law could result in civil fines and/or criminal prosecution for the Company and individuals involved.

Here is my situation:
I-485 is pending
H1 Visa will expire on Feb 26, 2009 (extension has been filed but have not received the receipt notice). Company will not file for premium processing due to budget cuts.
I have an EAD (valid until 2010) but did not renew my AP (expired this week).
I am going out of the country and will return on Feb 22, 2009.
Will there be any problems at the port of entry? Has anybody come back into the country with little time left on the H1B?

Just curious How Fast???
I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

Hello Friends,
My EAD card is probably lost in the mail. Got approved on July 11th and never received so far . My current EAD expires on Augest 9th . I am in the risk of losing the Job. What are my options now .. Please advise ..
I called USCIS, they are asking me to wait for 30 days .
Contact your local Congressman and explain him your situation he should be able to help in such a situation.

I switched my job in first week of October this year and My new employer filed the H1B transfer petition on Sep 26 (USCIS Receipt date). It has been almost two months and USCIS online status still shows case received and pending, while California State Center processing dates shown Oct 15 which is 20 days after Sep 26.
Is there anyone who has expereineced the same and want to share?
I am bit concerned because my employer has started the GC process and will be ready to submit the PERM application in few weeks.

I had the same situation but in vermot center and it took 20 days to get transfered to the new company as i did file in Premium Processing, but a friend of mine did applied in regular as you did nd it took exactly 3 months to get it transfered.
So i think your will be done in Jan 2007 do not worry.

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?

That depends on whether you were subject to a 2-year home residence requirement because of being in J-1 status. If you were subject to this requirement, and didn't fulfill it or get a waiver, you need to do one or the other before you get permanent residence approved.

These days with tons and tons of I-485 applications received every morning, how is USCIS gonna decide which one to process first?
If it's strictly on "first received, first processed" base, then it may well be that one guy with 3/07 PD date may have his application processed earlier (thus earlier AP and EAD) than one with 5/06 PD date. Simply because the 3/07 PD guy sent out the package much earlier than the 5/06 PD one.
Do I understand correctly?

There are still some new members who keep posting that the bill S 1348 looks very good and it has SKIL provisions etc, because they get pointed to the last year's bill.
If you go on thomas.loc.gov and find bill text for S. 1348 you see a bill that is a copy-paste version of LAST YEAR'S SENATE BILL S. 2611.
That text is last years text that was initially put in place as a place-holder BEFORE the grand compromise was reached.
After the grand bargin (compromise/coalition) was reached, the text of the grand compromise replaced the entire text of last year's bill (that has SKIL) was the next text.
Amendment # 1150 (S.A. 1150) Sponsored by Sen. Kennedy is a 400 page amendment that replaces the entire text that was intially in the bill with the new text. Its a "Substitute" amendment.
Read the S. A. 1150 text. Its also on IV homepage as PDF. That is the bill now. Here is the link to that

How difficult would it be to work with the USCIS dept to "allow" filing of I-485 stage on a continuous basis when priority dates are not current? In the current scenario they are pre-adjudicating cases up to July 2007 and are allocating visa's number to them as and when DOS makes them available. They can might as well allow a continuous filing of 1-485, pre-adjudicate them, and then we can wait when DOS gives the visa numbers to get the GC. On the USCIS side of things they will at least reduce their deficit, from fees for i-485, EAD, AP, Renewals. On our side we get the EAD which eliminates employer dependency, visa stamping, visa renewal, proving employer-employee headache. This may sound like a baby step to streamline the GC process. Will this need any type of legislative effort? Is this possible?

The documents you need to be able to legally marry depend on the rules where you intend to get married. It is not really an immigration question.

With new DOL policies and increasing immigration and labor standards enforcement, approval rates for labor transfers are down drastically. AILA reports even approval rates for PERM are down to 62% from the 80% approval rates seen earlier. Be careful, and have another parallel 'regular' filing so in case your sub labor gets rejected you don't loose additional Piority Date time.

I recently changed my status from L1A to H1 this year and I applied for L2 to H4 for my wife also.They asked for evidence of document for my case and by default my wife case also changed to asked for evidence. But they had sent letter only to me asking to submit the document.So I thought that when i sent the document for my case, they will change the status of her. I submitted my document and i got my H1 approved. But her status is still asking for evidence. I contacted USCIS and they said they will send the letter for her. But its been more than 4 months, i didn't get any response. When I contacted one attorney they said, since I have applied for H4 status myself, they couldn't do anything.
I asked whether I can refile, they said no, because if I refile now, her status is already out of status. They didn't tell me a clear answer what to do next.
I sent a detailed letter to USCIS texas with all the details.But no response. What is the other alternative options in this case.
If my wife go back to india, and apply for H4 stamping, does it get rejected, because her status indicates, asked for evidence?
